Terms of Service

These terms are an agreement between you and Foundry BLVD, which operates Campers Camp. By using camperscamp.com and related services (the "Service"), you agree to them.
1. Acceptance of terms
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you confirm you are authorized to accept these Terms for it, and "you" includes that organization.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. Parents and legal guardians may add information about their children. Children may not create accounts.
3. The Service
Campers Camp gives camps and youth programs ("Organizations") tools to publish camps, register families, collect waivers and manage rosters, and gives families ("Parents") a place to manage their household and registrations. Campers Camp provides the software only. We do not run camps, and we are not a party to any agreement between an Organization and a family.
4. Accounts
- Keep your sign-in email secure. You are responsible for activity on your account.
- Give accurate information, including about your children, and keep it up to date.
- Tell us right away at hello@camperscamp.com if you think your account has been used without permission.
5. Organizations: plans, billing and responsibilities
- Organizations subscribe to a plan with a seasonal camper limit. New Organizations start with a free trial. Plans renew automatically until cancelled. You can switch plans, pause on the Off-season plan, or cancel from your billing settings.
- Fees are charged in advance and are not refundable except where the law requires. Prices may change with notice before your next renewal.
- If a subscription ends or a plan limit is reached, new registrations may be waitlisted until the plan is changed. Your records remain available.
- Organizations are responsible for their camps, their staff, how they use families' information, and the content of their own waivers and policies. Waiver templates and tools do not replace advice from your own attorney.
- Organizations must have the right to collect the information they request and must protect any information they export, such as medical reports.
6. Families: registrations and payments
- Registrations, prices, refunds and camp policies are set by each Organization. Contact the camp with questions about a registration.
- Payments to an Organization are processed by Stripe and paid directly to that Organization. Campers Camp does not charge families fees on those payments.
- When you e-sign a waiver, you agree that your typed name is your legal signature, on behalf of yourself and the child you register.
7. Acceptable use
You agree not to:
- Break the law, or violate anyone's privacy or rights.
- Upload information you do not have the right to share, or that is false or misleading.
- Access accounts, records or data that are not yours, or try to get around security or plan limits.
- Disrupt the Service, introduce malware, or scrape or copy the Service.
- Use the Service to send spam or harass anyone.
8. Intellectual property
The Service, including its software, design and branding, belongs to Foundry BLVD and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms.
9. Your content
You keep ownership of the information you add to the Service. You give us permission to host, process and display it only as needed to provide the Service to you and to the Organizations you choose to share it with.
10. Third-party services
The Service relies on third parties such as Stripe for payments. Their terms and privacy policies apply to your use of their services. We are not responsible for third-party services or websites linked from the Service.
11. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free or secure.
12. Limitation of liability
To the fullest extent allowed by law, Foundry BLVD will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or $100. Campers Camp is not responsible for the operation of any camp or for injuries or losses that occur at a camp.
13. Indemnification
You agree to defend and indemnify Foundry BLVD against claims arising from your use of the Service, your content, your camps or programs (for Organizations), or your violation of these Terms.
14. Termination
You can stop using the Service at any time. We may suspend or end access if you violate these Terms or if needed to protect the Service or its users. Sections that by their nature should continue after termination will continue, including ownership, disclaimers, limitation of liability and indemnification.
15. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict of laws rules. Subject to section 16, any legal action will be brought in the state or federal courts located in Los Angeles County, California.
16. Dispute resolution
Before filing a claim, you agree to contact us at hello@camperscamp.com and try to resolve the dispute informally for at least 30 days. Either party may bring a claim in small claims court if it qualifies.
17. Changes to these terms
We may update these Terms. If we make significant changes, we will notify you through the Service or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.
